{"id":2809,"date":"2021-11-29T16:23:13","date_gmt":"2021-11-29T14:23:13","guid":{"rendered":"https:\/\/www.upc.edu\/cau\/blog\/?p=2809"},"modified":"2021-11-29T16:26:30","modified_gmt":"2021-11-29T14:26:30","slug":"sobre-el-calendari-laboral-upc-2022","status":"publish","type":"post","link":"https:\/\/www.upc.edu\/cau\/blog\/?p=2809","title":{"rendered":"Sobre el calendari laboral UPC 2022"},"content":{"rendered":"\n<p>Companyes i companys,<\/p>\n\n\n\n<p>des del Comit\u00e8 d\u2019Empresa i la ger\u00e8ncia de la Universitat s\u2019ha arribat a un preacord de calendari pel 2022. \u00c9s un preacord que mant\u00e9 la l\u00ednia del calendari de l\u2019any 2021. Entre altres q\u00fcestions, mant\u00e9 la jornada continuada i redu\u00efda d\u2019estiu, set dies de tancament per baixa ocupaci\u00f3 i dues opcions de vacances pel PAS Laboral: una repartint-les en dues quinzenes, amb l&#8217;acord previ del\/la responsable, entre juliol i agost (agost dintre del per\u00edode de baixa ocupaci\u00f3), i una segona opci\u00f3 de 14 dies h\u00e0bils dintre del tancament de l&#8217;agost i la possibilitat de fins a 8 dies acordats fora d&#8217;aquestes dates.<\/p>\n\n\n\n<p>Tant des del CAU com des de la CGT hem estat en contra de la signatura d\u2019aquest preacord i volem explicar-vos el perqu\u00e8 de la nostra posici\u00f3.&nbsp;<\/p>\n\n\n\n<p>Segons la nostra interpretaci\u00f3 de les diverses normatives d\u2019aplicaci\u00f3, els dies d\u2019assumptes propis que ens s\u00f3n d\u2019aplicaci\u00f3, segons l\u2019article 48 punt k de l\u2019EBEP, s\u2019han de considerar permisos no recuperables. Per tant, creiem que no s\u2019est\u00e0 aplicant la legalitat de forma correcta i aix\u00ed ho hem fet saber a la ger\u00e8ncia de la Universitat.<\/p>\n\n\n\n<p>Aquest fet implica que la ger\u00e8ncia ens obliga a treballar 42 hores per sobre de les 1.462 que marca el conveni, ja que aquests dies caldria considerar-los jornada laboral efectiva i, per tant, no recuperables. D\u2019igual manera que ho s\u00f3n els permisos per trasllat de domicili, casament, etc. D\u2019altra banda, pensem que els dies de tancament no s\u2019haurien&nbsp;de decidir unilateralment per l\u2019empresa.<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img src=\"https:\/\/mail.google.com\/mail\/u\/0?ui=2&amp;ik=afcf28600a&amp;attid=0.1&amp;permmsgid=msg-f:1717121462123868692&amp;th=17d470df4217b214&amp;view=fimg&amp;fur=ip&amp;sz=s0-l75-ft&amp;attbid=ANGjdJ8arAKqoJK_JPsFEvvetWyf36XMW4r52EPlOPWQGfindRzhhD8XwY0deVaMvfrOTAyVrCIA-F19Ud6Fkguga0KMxQt3GwHjGWJ9OGEzu7JAVv65F8_qW6_fAsI&amp;disp=emb&amp;realattid=ii_kwah2km00\" alt=\"image.png\"\/><\/figure>\n\n\n\n<p>Durant la negociaci\u00f3, la ger\u00e8ncia ha deixat clar que no est\u00e0 d\u2019acord en aquesta interpretaci\u00f3, i que en cas que la part social decideixi leg\u00edtimament emprendre les accions legals que consideri oportunes en contra d&#8217;aquest calendari, a fi d&#8217;aclarir la interpretaci\u00f3 i c\u00f2mput dels dies d&#8217;AP, es reserva el dret de retirar algunes mesures del preacord. Interpretem aix\u00f2 com una amena\u00e7a. En qualsevol cas, creiem que les sent\u00e8ncies judicials en aquest tipus de demandes ens fan confiar que aquesta \u00e9s la l\u00ednia que hem de seguir.
